STANDARD TERMS AND MOTORBIKE GENERAL CONDITIONS OF RENTAL

HP MOTORRAD SRL with legal head office in Milano Viale Lombardia,21 Cap 20098 Zona Industriale – Italy; P.iva 015173001980; Tel 0039027560772 Fax. (named from now “Landlord”) hire the motorcycle to the Renter for the period agreed.

1 ) Requirement

The rider must be over 18 years of age.  Documents required for rental: Valid international driving license, Id identity card or passport. HP Motorrad srl ( hereinafter referred as ‘Landlord’) delivers to the driver (hereinafter referred as ‘Renter’) the vehicle (identified on the front of this agreement) in good condition and perfectly working and the renter must return the vehicle in the same good condition at the end of rental period. The Renter, by signing the rental agreement and the specific approval of general conditions, declares to have verified that the motorcycle is in good conditions and appropriate for use agreed. The Renter agrees to don’t provide false information about their personal details (age, address and valid driving license) exempting the Landlord from every consequence in case of false statement. Who signs a rental agreement in name or on behalf of a third person, he or she will answers with the same one to the obligations of this agreement. The Renter is in charge of the actions and omissions of anyone who ride a motorcycle.

2 ) Renter obligations

Renter is obliged to:

2.1 Wear an approved ECE 22.06 safety helmet, carry the passenger with approved ECE 22.06 safety helmet, keep and use the motorcycle, together with the equipment provided, with due diligence and in compliance with the legal rules and requirements.

2.2 Ensure that greasing, lubrication and brake fluid are sufficient to guarantee maintenance and safety of the vehicle during the rental period. Use the motorcycle with care and diligence; Every damage suffered by the motorcycle for negligence will be under Renter’s expense. It is expressly forbidden to use any of Landlord’s vehicles for competition, rally, off road, motocross, race of trial of speed and during high stress conditions. Renter is responsible in case of any damage (falls, road accidents, dents, mechanical failures). If damages exceed motorcycle value, Renter will pay its entire market price.

2.3 All spending tickets, parking fines, congestion charges, tool charges and any other chargeable offence are Renter’s responsibility. I expressly authorise the Landlord to charge me that amounts, increased of € 50,00 + VAT (Italian tax) for administration costs and tracing rider. (see the attached form)

2.4 Indemnify the Landlord from any claims and/ or request made by a third person for possible damages that he or she and/or their own things suffered during rental period.

2.5 Pay back the Landlord, upon presentation of invoice or proof of payment, of all expenses included legal fees that the landlord himself had to pay to obtain pecuniary obligations.

2.6 It is intended that if on Renter’s request and with the authorisation of the Landlord, the vehicle and the keys are returned at closing time, the rental period will end at the time of the shop opening.

2.7 Keep and return the motorcycle in good conditions and perfectly working. Renters are responsible for any damage noticed when they drop off the vehicle and it will be charged as stated on this rental agreement.

2.8 Recognise to don’t have any real right on the rented vehicle and all the accessories included.

3) Renter commitments

Renter agrees to ride or use the vehicle personally. Nobody can drive the rented motorcycle except the Renter or the driver expressly authorised in the delivery documents. It is expressly forbidden to:

3.1 Driving outside national borders without the mandatory ‘Cross Border’ insurance extension

3.2 Driving outside the European Union without the Landlord’s written authorization and the execution of specific insurance, to be obtained at the border in countries where expressly required.

3.3 Transport people and/or goods for commercial purposes

3.4 Push or drag motorcycles or other things.

3.5 Drive under the influence of alcohol, hallucinogenic drugs, narcotics, sedatives or any other substance that may impair response time.

3.6 Use any of our vehicles on competitions, rally, off road, trial events, race of trial of speed whether between motor vehicles or otherwise.

3.7 Drive motorcycles in case of violation of any custom laws, driving regulation or other norms.

3.8 Drive in forbidden areas (airport, seaport, restricted areas)

3.9 Don’t provide real and valid documents and information otherwise the Renter shall be liable for any consequences for the fulfilment of this provision.

4.0 Rider must be over 18 years old.

4) Landlord liability limitation

The Landlord shall not be liable and the Renter renounce for himself to make claims towards the Company, for any damages suffered by the Renter, the passengers or third parties deriving from the use of the rented motorcycle or for the loss or damages to Renter’s things left on it or for any economic damages deriving from the delay in delivering, failures or any other causes beyond Landlord’s control.

5) Booking and cancellations

The Renter may book the motorcycles by email, telephone. With the booking the Renter must supply a copy of his/her driving license and his/her identity card. 30% of the selected tariff is requested at the confirmation of renting (it depends from motorcycle model and period).The Renter agrees to provide valid documents and information about him or her personal details, otherwise the Renter shall be liable for any consequences in case of false statements. If the motorcycle booked is not available at the time of pick up (e.g. previous Renter has damaged the same booked motorcycle) the Landlord will provide an alternative one, possibly an equivalent motorcycle than the booked. If the Renter requests to switch a booking to a less expensive motorcycle model, the original (higher) rental fee remains due in full. Any change to the driver’s name after the booking is confirmed will incur a €150.00 + VAT administrative fee. For accessory rentals (helmets, jackets, gloves), sizes must be specified in advance; otherwise, availability is limited to the stock present at the time of pick-up.  Any reduction in the rental duration after the booking is confirmed does not entitle the Renter to a refund; the original contract amount remains due in full. In the event of an early return (whether by the Renter’s choice or due to damages caused by the Renter’s fault), the full original rental fee must be paid and should the Renter wish to rent a replacement motorcycle, a new and separate rental agreement will be required. Any request to postpone a booking is subject to the Cancellation Policy; furthermore, the Renter must cover all incurred administrative and logistical expenses (e.g., transportation, insurance costs). For ‘One-Way Rental’ bookings, no refunds will be issued if the vehicle is instead returned to the original pick-up location. Rental rates are fixed and do not vary based on the specific optional features installed on the provided motorcycle.

6) Cancellation policy (pick up/drop off in HP Rental stations):

  • 30 days or more before the rental start date: The 30% deposit is non-refundable. However, it will be issued as a credit note valid exclusively for a new rental to be used within the following calendar season.
  • Between 30 and 15 days before the rental start date: The 30% deposit is forfeited in full and no credit note will be issued.
  • Less than 15 days before the rental start date: Renter is liable for 100% of the total rental amount (the full balance will be charged or retained).

7 ) Payment

At the time of booking the Renter must pay 30% of rental cost. The remaining 70% of total renting price must be paid at the motorcycle pick up (invoice will be sent by email). Motorcycle rental may be paid by cash and credit card. In case of delayed payment, an interest rate of European Bank increased by 3% will be applied.

8) Deposit/Caution

A security deposit is mandatory for every motorcycle rental. The Landlord reserves the right to process a pre-authorization on the credit card provided (Visa, Mastercard, American Express, etc.) between 7 and 0 days prior to the scheduled pick-up. It is the sole responsibility of the Renter to ensure that the credit card provided for the security deposit guarantees a sufficient credit limit (plafond) as required at the time of booking. The Renter hereby indemnifies and holds the Landlord harmless from any and all liability arising from delays or the refusal of authorisation resulting from technical issues, insufficient funds, or malfunction of the credit card provided at the time of vehicle collection.This pre-authorization serves as a guarantee for any potential costs incurred during the rental period, including but not limited to: Vehicle damage or theft, One-way rental fees (different drop-off locations), Rental extensions and unpaid traffic penalties, Loss of keys or original vehicle documents, Administrative fees for accident recovery and vehicle storage, Legal seizure costs and compensation for loss of use (loss of rental income) while the vehicle is being repaired or recovered.The deposit can also be used to pay third part if this exceeds insurance coverage. The Renter is obliged to refund the Landlord for any damage deriving from the theft of the vehicles or its accessories not covered by the insurance. The property of motorcycle is of the Landlord, by signing this agreement Renter has only the possession of motorcycle. The Landlord may terminate this agreement and take back the motorcycle at any time, at Renter’s charge, when the motorcycle is used without respecting this agreement and with damages that exceed the deposit value. In case of theft or damages (accident) where the vehicle cannot move any more the Renter has to pay in full the cost of the rental agreed at pick up with the unlimited km quotation; in case the Renter after a theft or a damage for his fault (accident) would like to change the motorcycle has to pay in full also the contract of the new motorcycle rented.

Administrative Costs: In the event of an accident, the Renter shall be liable for all additional administrative costs incurred by the Landlord (including vehicle recovery, fines, storage, seizure, and loss of use). These administrative charges are separate from the cost of repairing the actual damage. For this reason, the total amount can exceed both the insurance deductible (damage excess) and the security deposit already provided.

Accessories: In the event of an accident involving extra equipment (such as GPS, cases, helmets, jackets, or cameras), the Renter is liable for the full cost of the accessories in addition to the vehicle’s damage. This applies even if the vehicle damage alone already exceeds the security deposit. Loss of Use: If the vehicle is rendered unrentable due to repairs, the Renter will be charged for “Loss of Use” at the standard daily rate for the duration of the repair period, up to a maximum of 20 days. In the event of theft involving any extra accessories provided by the Landlord that do not constitute the vehicle’s standard factory equipment—including, but not limited to, GPS units, side cases, top cases, intercom systems, helmets, jackets, gloves, and cameras—the Renter shall be held strictly liable for the full replacement value of said items. Consequently, the Renter agrees to forfeit the total security deposit held for damages or theft and, in addition, shall be required to reimburse the Landlord for the remaining balance of the fair market value of the stolen accessories. The Landlord reserves the right to notify the Renter of any damages discovered after the formal conclusion of the rental period. Such notification shall be provided via email, accompanied by photographic evidence, in instances where damages were not readily apparent at the time of drop-off. This includes, but is not limited to, third-party accident claims, mechanical issues identifiable only during operation, or defects obscured by dirt that become visible only after cleaning (including evidence of unauthorised track or off-road use). Accordingly, the Landlord maintains the right to process a “delayed charge” against the Renter’s credit card provided as a security deposit to cover the full cost of the detected damages.

9) Pick up and drop off

Motorcycles are delivered at the rental stations shown on website www.hpmotorrad.rentals or at other locations in according with the Renter, where the motorcycles must be returned at the agreed date and time. The motorcycles are delivered in good conditions and perfectly working. At the time of vehicle delivery, the Renter is required to conduct a thorough inspection of the motorcycle’s condition prior to departure. Any discrepancies, pre-existing damages, or defects must be immediately reported to the Staff supported by clear photographic evidence. In the absence of such communication before departure, the vehicle shall be deemed to be in perfect condition, fully compliant with the agreement, fit for use and no claims regarding the vehicle’s aesthetic or mechanical condition will be accepted once the Renter has left the rental station. Should the Renter cause any damage to the motorcycle during the rental period, they shall promptly inform the Landlord and provide photographic evidence thereof.Should the Renter cause any damage to the motorcycle during the rental period, he shall promptly inform the Landlord and provide photographic evidence thereof. It is expressly forbidden to return the motorcycles during the closing time. The motorcycles must be returned during working hours ( see official website) only to one of the Company employees. The Renter is obliged to pay a penalty (see art. 15) if the motorcycle is returned later than 30 minutes after the agreed time.The motorcycles must be returned with all its accessories (GPS, helmets, gloves, jackets, rain jackets, intercoms, side cases, top cases, chain), keys and documents supplied at the delivery otherwise the Renter will be obliged to pay a penal (see art. 12). In case of an early termination of rental period due to Renter choice and not due to Landlord request or motorcycle technical fault or engine failure it will be not possible to get a refund for the remaining rental period. At the drop off, the Renter undertakes to inform the Landlord for any fine incurred during the rental period. In case of late drop off of more than 24 hours of  delay (considering the drop off time on the contract) without any information from the Renter (except in case of accident) , the landlord will call the police to report the event. The Renter will cover the penal of € 500 + VAT and the police expense. In case of Custom drop off (out of rental station specified online) the Renter will have to pay the amount of the administrative expense (Parking and other fees included) till the time of the motorcycle will be picked up.

10) Insurance

The rented motorcycles are insured for third part liability as per current regulations (for damages caused to third part excluding the driver – the deductible depends by the vehicle). The Renter is authorized to use the vehicle within the European Community and Switzerland, subject to the prior acquisition of the”Cross Border.” extension.  Any travel outside of this area must be expressly authorized in writing by the Landlord and may be subject to the mandatory subscription of specific insurance policies as required by the prevailing laws of the countries of transit.  The Renter has not insurance cover in case of: 1)use of the vehicle outside of national borders without the prior purchase and activation of the specific extension known as “Cross Border” 2) – damages to the vehicle in the event of accidents caused by the driver; 3) – damages to the vehicle when the Renter cannot provide data and information of the event and identify the other driver involved; 4) – damages to the driver, passengers and/or their goods; 5) – damages deriving from competitions, rally, off road, trial events, races of trial of speed whether between motor vehicles or otherwise; 6) – damages when the driver is under the influence of alcohol, hallucinogenic drugs, narcotics, sedatives or any other substance that may impair response time; 7) – damages deriving from accidents not related within the prescribed time; 8) – damages caused by drivers’ lack of skill and experience and/or breaking of rules of the road; 9) – damages occurred in countries where the green card is not valid; 10) – damages deriving from the transport with tow truck and/or the repatriation of the vehicle; 11) – damages caused by civil liability and/ or to third part and goods beyond the maximum coverage; 12) – damages deriving from vandalism, weather events, explosions, wars, earthquakes, fires, public events; 13) – damages deriving from Renter’s negligence. Insurance extensions (such as e.g. Supercover VIP), shall be rendered null and void if the Renter tests positive for alcohol or drug substances following an accident.

Theft & Fire: In the event of theft, this Agreement shall be automatically terminated. The Renter shall be liable for the applicable insurance excess plus a mileage charge equal to the distance between the rental location and the place where the theft occurred (excluding contracts where unlimited mileage is already included). All motorcycles are provided with chain, and padlock. These must be used every time the vehicle is parked. If the motorcycle is parked on public roads and stolen and these security devices were not properly installed, the Renter will be liable for the full value of the vehicle and accessories. In such cases, all supplementary insurance (including Supercover and Supercover VIP) will be voided.

Theft Notification Procedures: In the event of theft, the Renter must immediately notify the Landlord using the contact details provided in the Rental Agreement. A formal report to the competent authorities (Police or Carabinieri) must be filed within and no later than 6 hours from the discovery of the theft. A copy of the official police report must be forwarded to the Landlord immediately thereafter.

Vehicle Recovery: In the event the vehicle is recovered, the Renter shall be entitled to the refund of the insurance excess (deductible), subject to the following deductions: Any damages identified upon recovery of the vehicle, Recalculation of extra mileage charges (excluding contracts with unlimited mileage), Loss of Use for the period between the original scheduled return date and the date of recovery.The vehicle may be equipped with a GPS tracking system used exclusively for security, anti-theft, and contract compliance (e.g., cross-border monitoring). Data will be accessed only when strictly necessary and may be shared with authorities in case of theft or breach. By signing, the Renter acknowledges and consents to such monitoring for the duration of the rental.

11) Accidents with third-party involved

Accident Documentation and Procedures: The completion of all documentation regarding the dynamics of an accident is reserved exclusively to the Landlord and the competent authorities. The Renter expressly agrees not to sign any statement of liability or accident report without the Landlor’s express authorization (CID/Friendly Accident Report) and undertakes to provide all information requested by the Landlord to enable the proper management of the insurance claim.

In case of accidents (also between two or more motorcycles rented) the Renter is obliged to:

a) – immediately inform the Landlord by telephone and send by email within 6 hours the internal accident report form provided with the Contract filled in every part.

b) – inform the closest authorities.

c) – don’t make statements of his/her responsibility

d) – take note of every name and address of all those involved and of witnesses including information about the Insurance Company (company, number of insurance policy, agency)

e) – provide any useful information to the Landlord;

f) – follow the instructions that the Landlord will provide concerning the store and or repair of the vehicle.                                                                                                                                  

Non-Compliance and Liability: Failure by the Renter to comply with the aforementioned provisions, which may result in the voiding of insurance coverage, shall render the Renter jointly and severally liable for all resulting damages and costs.

12) Damages

The Renter is obliged to refund the landlord for any damage caused to the vehicle and/or to the accessories and also for the expenditure on administrative management of the accident ( vehicle recovery; vehicle storage and renting costs during this period, vehicle impoundment and renting costs during this period). The Renter agrees to inform within 6 hours any accident which has caused the damage (also small evidence) occurred during the rental period.

In case of damages the Landlord will present to the Renter the estimation cost for the damage, all damaged pieces will be replaced with new ones. The repair cost estimate shall be determined by the HP Motorrad service center, based exclusively on the official manufacturer’s price list for original spare parts. The Landlord will also send the estimation cost and the pictures of the damage to the Renter by mail informing him. Should the Renter request a formal technical inspection or a detailed photographic report from the dealership, a service fee of € 500 + VAT shall be applied.

13) Failure of the motorcycle

If the failure is not due to Renter’s fault, the Renter shall be entitled to the substitution, if possible, with the same vehicle or similar model. If the replacement of the vehicle is not possible in the period agreed for the rent the Renter will be refunded for the rental period not used.The Renter shall not be entitled to any refund other than the actual cost of the unused rental period. The Landlord agrees to refund to the Renter the total amount paid for repairs due to fault of the motorcycle only when authorised by the Landlord and in the presence of a regular invoice directed to the Landlord. Unauthorised invoices won’t be refunded. Tire puncture must be repaired by the Renter at his expenses. For safety reasons, any tires that have been repaired during the rental period will be replaced upon return. The cost of the replacement tires will be charged to the Renter at the current market price. In the event of burned-out light bulb the Renter will change it under his expense and may be reimbursed for such expenses upon presentation of a valid original receipt.  It is strictly forbidden to abandon the motorcycle without Landlord authorisation; in this particular case the renter must refund all the costs required to recover the motorcycle and a penalty charge of € 2.500 + VAT.

14 ) Vehicle Impoundment

In case of vehicle impoundment by judicial authorities for reasons attributable to the Renter, the Landlord will apply an administrative fee for arising costs and a “loss of use” charge at the same daily rental rate applied on this contract – until the release of the motorcycle – with a maximum equal to the value of the vehicle at the ending time of the agreed rental period.

15) Rental conditions

Weekend Formula: This special rate applies exclusively from Friday (starting 16:00) to Monday (ending 10:00). The vehicle must be returned strictly by the time indicated on the rental agreement.

Insurance and VAT: Prices include VAT and Standard Insurance. Under the Standard Insurance, the Renter is provided with Third-Party Liability (RC) insurance, which exclusively covers damages caused to third parties. In the event of damage or theft of the rented vehicle, the Renter shall be held liable up to the full replacement value of the vehicle, as no insurance excess or deductible applies to this coverage level. It’s available for selected vehicles, Comprehensive Insurance (“Supercover or Supercover VIP”) that may be activated for an additional daily fee, subject to a deductible. A deductible (excess) applies in the event of an accident, fire, or theft (subject to specific exclusions).

Model Pricing: Rates are uniform across variants of the same model (e.g., Ducati Multistrada V4S and V4 Standard are billed at the same rate).

Minimum Rental: The minimum rental period is 24 hours. This one-day minimum is only available from Monday to Thursday. Rentals spanning the weekend are subject to the Weekend Formula or multi-day rates.

Station Pricing & Mileage: Standard web prices apply only to Milan and Rome locations. Rates for Naples, Venice, Turin, Como, Zurich, and Lugano are available upon request and include unlimited mileage only. Premium rates and mandatory unlimited mileage apply during major events (e.g., World Ducati Week, Guzzi Days, BMW Motorrad Days, Mugello, and Misano GP). During high season from May 26th to July 8th and from August 26th to September 30th rates are increased by 10%.

License Requirements: It is strictly forbidden to rent a motorcycle with a learner’s permit.

Fuel Policy: The vehicle is delivered with a specific fuel level and must be returned with the same amount. If returned with less fuel, the Renter will be charged for the missing fuel plus a €30 + VAT refuelling service fee.

Luggage Shipping: At the Renter’s expense, the Landlord can arrange luggage transfer between locations. Renter must provide accurate dimensions and addresses in advance. This service is managed by a third-party provider; the Landlord assumes no liability for the shipping process. The service must be confirmed and paid separately from the motorcycle rental. The Renter agrees to pay the following additional fees to the Landlord:

Return After Closing Hours:(without Out of Hours service previously agreed)

Within 30-minute of late return a €50.00 + VAT will be applied. Returns exceeding 30 minutes past closing time will result in the charge of “unlimited mileage” rental rate.

Delays Beyond Agreed Time:

Up to 30 minutes late a €30.00 + VAT surcharge applies. More than 30 minutes late, the Renter will be charged for “unlimited mileage” rental rate

Consequential Damages: If the delay causes the Landlord to lose a subsequent booking, the Renter is liable for any refunds or compensation claims made by the following Renter.

Holiday & Weekend Service: Pick-ups and returns on weekends or public holidays require prior authorization and an appointment. An “Out of Hours” fee of €39 VAT included per vehicle applies.

16) Charge

–Loss and/or damages and/or theft of:  Documents € 250+VAT  – –Loss and/or damages and/or theft of:  Standard Keys € 500+VAT Keyless keys € 700+VAT  – Loss and/or damages and/or theft of:  Plate € 700+VAT – –Motorcycle abandonment € 2500+VAT

17) Disputes

The present rental agreement is governed by Italian Laws. Any dispute between the parties relating to or arising from this agreement shall be submitted to the jurisdiction and the competent court where HP Motorrad is legally established (jurisdiction and competent court of Milano – Italy).

18) Translation

In the event of any conflict between the original Italian version of this agreement and the English version, the Italian one will prevail. The English version is considered only a translation.

19) Privacy Policy

The Tenant declares to have received, read and understood the privacy information pursuant to art. 13 EU Regulation 2016/679 (GDPR) viewable on the website at the address https://www.hpmotorrad.rentals/en/content/8-gdpr  In accordance with the Articles 1341 – 1342 of Italian Civil Code, I declare that I have carefully read and specifically approve the above-mentioned clauses.
